Terms of Service

These Terms of Service ("Terms") govern your access to and use of Letheca (the "Service"), operated by Edge Case Software, LLC, a Pennsylvania Limited Liability Company ("we," "us," or "our"). By accessing or using Letheca, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
Letheca is an anonymous, ephemeral public message board. Users may post short text messages ("Drops") that are visible to the public and automatically deleted after 24 hours. Users may anonymously endorse posts via the "Echo" mechanic. Posts that accumulate sufficient Echoes before deletion may be permanently preserved as a brief summary ("Ghost Trace") in the public archive.
The Service is provided as-is. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.
2. Eligibility
You must be at least 18 years of age to use Letheca. By using the Service, you represent and warrant that you are 18 years of age or older. If you are under 18, you are not permitted to access or use the Service.
Letheca does not knowingly permit persons under 18 to use the Service. If we become aware that a person under 18 has submitted content, we will take steps to remove it.
3. Clickwrap Agreement
When you first access Letheca, you will be presented with a brief notice confirming that you are 18 or older and agree to these Terms. You must affirmatively click or tap to dismiss this notice before accessing the Service. This action constitutes your electronic agreement to these Terms and your representation that you meet the age requirement. If you do not agree, you must not use the Service.
4. Anonymous Use and No Accounts
Letheca does not require account registration. No username, email address, or other personally identifiable information is required to post or interact with the Service. We do not store IP addresses, device identifiers, or other tracking data in association with user-submitted content.
Because the Service is anonymous by design, we have no ability to verify the identity of any user or to restore access to any content once it is deleted.
5. User Content
5.1 Your Responsibility. You are solely responsible for any content you submit to Letheca ("User Content"). By submitting User Content, you represent and warrant that you have the right to submit the content, the content does not violate any applicable law, and the content complies with these Terms.
5.2 License to Us. By submitting User Content, you grant Edge Case Software, LLC a worldwide, royalty-free, non-exclusive license to display, reproduce, and distribute your content solely for the purpose of operating the Service, including publishing Ghost Traces in the permanent archive.
5.3 Ghost Traces. If your Drop accumulates sufficient Echoes before expiration, a brief summary or excerpt of your Drop may be preserved permanently as a Ghost Trace in the public archive. You acknowledge and agree that Ghost Traces are permanent and cannot be removed by you after creation. We retain sole discretion to remove Ghost Traces for any reason.
6. Prohibited Conduct
You agree not to use the Service to submit content that is unlawful, threatening, harassing, abusive, defamatory, or obscene; constitutes or promotes illegal activity; exploits, harms, or threatens children in any way; infringes intellectual property rights; contains spam or unsolicited advertising; impersonates any person; contains malicious code; or interferes with the Service.
We reserve the right to remove any content that violates these Terms or that we determine to be harmful, offensive, or otherwise inappropriate.
7. Section 230 Notice
Letheca is an interactive computer service as defined under 47 U.S.C. Section 230 of the Communications Decency Act. We are not the publisher or speaker of any User Content submitted to the Service.
8. Content Moderation
We reserve the right, but are not obligated, to monitor, edit, or remove any User Content at any time and for any reason. To report content that violates these Terms, contact us at: contact@letheca.app
9. Intellectual Property
The Letheca name, logo, product design, and all related software and content created by Edge Case Software, LLC are the exclusive property of Edge Case Software, LLC and are protected by applicable intellectual property laws.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EDGE CASE SOFTWARE, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED $100.
12. Indemnification
You agree to indemnify, defend, and hold harmless Edge Case Software, LLC from and against any claims, liabilities, damages, and expenses arising out of your access to or use of the Service, your User Content, or your violation of these Terms.
13. Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania. Any dispute shall be resolved exclusively in the state or federal courts located in Pennsylvania. YOU WAIVE ANY RIGHT TO A JURY TRIAL.
14. Changes to These Terms
We reserve the right to modify these Terms at any time. Your continued use of the Service constitutes acceptance of the revised Terms.
